Introduction
Welcome to TakeAroad. By booking a tour or using our website, you agree to comply with and be bound by the following terms and conditions. These terms and conditions, along with our privacy policy, govern Take a Road's relationship with you in relation to our tours and website.
Booking and Payment
A booking is considered confirmed only upon receipt of a deposit or full payment, as specified in the tour package details.
Confirmation is subject to availability and receipt of all necessary documentation and information required by Take a Road.
All bookings are subject to acceptance by Take a Road, which will be communicated in writing.
Booking Confirmation
Deposit
A refundable deposit of 10% of the total tour cost is required to secure your booking. This deposit is required within 24 hours of making the reservation.
If the deposit is not received within the specified timeframe, the booking may be cancelled without further notice.
Deposits are non-transferable and cannot be used for future bookings.
Final Payment
The balance must be paid in full 7 days before the tour departure date. Failure to do so may result in the cancellation of the booking.
If a booking is made within 7 days of the departure date, the full amount is payable at the time of booking.
All final payments must be made in the currency specified on the invoice or as agreed upon at the time of booking.
Payment Methods
We accept payments via credit card, bank transfer, and other specified payment methods listed on our website.
Credit card payments may incur a processing fee, which will be communicated at the time of payment.

Price Inclusions and Exclusions
The tour price includes all inclusions listed in the tour itinerary, such as accommodation, meals, transportation, and guided tours.
Exclusions, such as visa fees, travel insurance, personal expenses, and gratuities, are detailed in the tour package information.
Prices are based on exchange rates at the time of booking and may be subject to change due to fluctuations in currency exchange rates or other factors.
Cancellations and Refunds
Cancellation by Client
If you need to cancel your booking, the following cancellation fees apply:
- More than 7 days before departure: 10% of the total tour cost.
- to 6 days before departure: 50% of the total tour cost.
- Less than 2 days before departure: 100% of the total tour cost.
All cancellations must be made in writing and will be effective upon receipt by TakeAroad.
In the event of a cancellation, any refunds due will be processed within 24 hours of receipt of the written cancellation notice.
Cancellation by Company
We reserve the right to cancel a tour due to unforeseen circumstances, including but not limited to insufficient bookings, natural disasters, or political instability. In such cases, a full refund will be provided, or an alternative tour will be offered.
If the alternative tour is not acceptable to the client, the client is entitled to a full refund of the monies paid to TakeAroad.
We are not responsible for any additional expenses incurred by clients as a result of a tour cancellation, such as visa fees, vaccinations, or travel arrangements.
Refund Process
Refunds will be processed within 24 hours of cancellation notification and will be made via the original payment method.
No refunds will be given for any unused portion of a tour once it has commenced, including but not limited to missed meals, activities, or accommodation.
In cases where a refund is granted, the refund will be calculated based on the actual costs incurred by Take a Road and may not include the full amount paid by the client.
Changes to Bookings
Client-Initiated Changes
Any changes to bookings must be requested in writing. While we will endeavor to accommodate changes, they are subject to availability and may incur additional charges.
Changes requested within 7 days of the departure date may be treated as a cancellation and rebooking, and cancellation fees may apply.
Changes to the itinerary, departure date, or accommodation may result in additional costs, which will be communicated to the client in advance.
Company-Initiated Changes
We reserve the right to make minor changes to the tour itinerary due to operational or safety reasons. In the unlikely event of significant changes, clients will be notified as soon as possible and offered alternatives or a full refund.
Significant changes include changes to the departure date, change of accommodation to a lower standard, and alterations to the main itinerary affecting the overall travel experience.
In the event of a significant change, clients may accept the change, choose an alternative tour, or cancel their booking for a full refund.
Travel Insurance
Mandatory Insurance
All clients are required to have comprehensive travel insurance that covers personal injury, medical expenses, repatriation, loss of luggage, and cancellation.
Take a Road is not responsible for any costs incurred by clients who fail to obtain adequate insurance coverage.
Clients are responsible for ensuring their travel insurance covers the specific activities included in the tour.
Insurance Details
Clients must provide the company with emergency contact information prior to the commencement of the tour.
It is the client’s responsibility to ensure that the insurance covers the entirety of the activities included in the tour.
In the event of a claim, clients must follow the insurance provider's procedures and notify TakeAroad of any incidents that may affect the tour.
Health and Safety
Health Requirements
Clients are responsible for ensuring they are in good health and fit to undertake the tour. Any pre-existing medical conditions must be disclosed at the time of booking.
Clients must ensure that they have received all necessary vaccinations and medical advice for the destinations visited.
Take a Road reserves the right to refuse participation to any client who, in the opinion of our staff, is not fit for the tour.
Safety Regulations
Clients must adhere to the safety instructions provided by the tour guides and staff at all times. Failure to do so may result in being removed from the tour.
Clients must follow local laws and respect the customs and traditions of the destinations visited.
Any behavior that is deemed unsafe, disruptive, or offensive may result in the removal of the client from the tour.
Medical Assistance
In the event of illness or injury, clients should seek medical assistance immediately. TakeAroad will assist in locating medical services but is not responsible for the quality or outcome of such services.
Clients are responsible for any medical expenses incurred during the tour, including transportation to medical facilities.
TakeAroad recommends that clients carry a basic first aid kit and any necessary prescription medications.
Liability
Company Liability
TakeAroad is not liable for any injury, loss, damage, delay, or inconvenience caused by events beyond our control, including but not limited to natural disasters, accidents, or acts of government.
While all reasonable care is taken to ensure that services and accommodations are safe and of high quality, Take a Road does not accept responsibility for any loss or damage resulting from acts of third-party service providers.
Our liability is limited to the price paid for the tour. We do not accept liability for any indirect or consequential loss or damage.
Client Responsibility
Clients are responsible for their personal belongings and are advised to take necessary precautions to safeguard their valuables. Take a Road is not responsible for any loss, theft, or damage to personal belongings.
Clients are required to have appropriate and valid travel documents, including passports and visas. TakeAroad is not responsible for any issues arising from improper travel documentation.
Clients must comply with the terms and conditions of third-party service providers, including airlines, hotels, and activity operators.
Photography and Media
Consent
By participating in our tours, clients may consent to being photographed or filmed for promotional purposes. If you do not wish to be included, please inform us in writing before the tour.
Photographs and videos taken by our guides or staff during the tour may be used on our website, social media, and promotional materials.
Clients may request copies of photographs or videos taken during the tour, subject to availability.
Use of Media
Any photographs or videos taken by clients during the tour must not be used for commercial purposes without our prior written consent.
Clients are encouraged to share their experiences on social media, tagging TakeAroad where appropriate.
Any media content shared by clients must not infringe on the privacy or rights of other participants or staff.
Governing Law
These terms and conditions are governed by the laws of Kenya, and any disputes arising from or related to the use of our services or website will be subject to the exclusive jurisdiction of the courts in Kenya.
Amendments
Take a Road reserves the right to amend these terms and conditions at any time. Clients will be notified of any significant changes via email or through a notice on our website. Continued use of our services or website following any changes will be deemed as acceptance of the new terms and conditions.
Complaints and Dispute Resolution
Complaints Procedure
If you have a complaint during your tour, please inform your tour guide or a TakeAroad Company representative immediately so that we can attempt to resolve the issue on the spot.
If the issue is not resolved to your satisfaction, please submit a written complaint to our head office within 7 days of the tour's conclusion.
All complaints will be thoroughly investigated, and a response will be provided within 7 days of receipt.
Dispute Resolution
In the event of a dispute, both parties agree to seek resolution through mediation before pursuing legal action. Mediation will be conducted by a neutral third party agreed upon by both parties.
If mediation fails, the dispute will be resolved through arbitration.
Clients agree that any disputes arising from or related to the tour will be governed by the laws of Kenya.
Data Collection
We collect personal information necessary for the processing of bookings and the provision of services. This includes, but is not limited to, names, contact details, and payment information.
Personal information is collected through our website, booking forms, and direct communication.
